ADDITIONAL INFORMATION ON PROPOSED SETTLEMENT OF CUSTOMER CLASS ACTIONS, SUBJECT TO COURT APPROVAL

We believe that the proposed settlement of the customer class actions would offer an excellent resolution for our customers, addressing the different ways that they have told us that they have been impacted by the computer intrusion(s).

The settlement of these class actions is subject to court approval and other conditions. Customers cannot claim settlement benefits at this time.
  • The settlement is not yet final, and its terms may change. Like all class action settlements, it is subject to court approval and other conditions.

  • As is typical for class actions, the procedures required to obtain approval of the settlement will take some time. We cannot currently predict how long these procedures will take.

  • Customers cannot submit claims for benefits under the settlement at this time.

  • If the court preliminarily approves a settlement, more information will be made available through newspapers and other publications, on our websites, and for some customers, by letter about:

    • what the proposed settlement benefits are,

    • who will be eligible for the benefits, and

    • how and when to claim eligibility to participate.

  • After preliminary approval of a settlement, the court will appoint an administrator to provide information about the settlement, create a website for the settlement, manage claims, and answer questions.
